Receive advice on how to get help immediately after having received a notice of termination to move on with your career as best as possible.

The time right after a termination is usually the hardest. But it is also a time that calls for important clarifications and decisions. Read on here to learn about some of the key matters to pay attention to and the advice and support offered by Finansforbundet in order to help you move on with your career as best as possible.

As a member of Finansforbundet, you may receive legal advice if you have been terminated. You may contact our lawyers about the following topics:

  • Whether the reason for your termination is fair
  • Whether the notice period has been complied with
  • Your rights under the collective agreement and legislation.

If you are presented with a severance agreement, we recommend you to contact our lawyers or your union representative before signing the agreement as most severance agreements are signed in full and final settlement.

If you have been dismissed summarily, it is vital that you:

  • Immediately contact your unemployment insurance fund
  • Immediately object to the dismissal to your employer
  • Involve your union representative, the local branch or Finansforbundet, who will be able to help you submit a claim for damages in terms of pay and holiday pay and any compensation in the event of unfair dismissal.

A mandatory deadline of four weeks applies from your receipt of a notice of termination or a summary dismissal to your submission of a potential claim, for example, a claim for compensation for unfair dismissal, against the company. Therefore, please contact our lawyers or your local branch in due time for us to make a legal assessment of your case.

If special challenges are linked to your termination, such as illness or maternity/paternity leave, you may ask Finansforbundet's social workers for advice.

They will be able to advise you on the following topics:

  • Your position if you are terminated during absence due to illness
  • Your opportunities and obligations as a non-employed flex-job worker
  • When severance pay will be set off against public benefits
  • Your possibilities of maternity/paternity leave in a notice period

Have you been released from your duties?

If you have been released from your duty to work, it means that you will be paid but do not have to work. In addition, you must be loyal to your employer and not take up a job with a competing business.

But there are also other legal elements you should pay attention to:

  • Duty of loss minimisation: When released from your duties, you are under an obligation to limit the loss of your employer by attempting to find a new job against which your employer may set off your pay.
  • Employers' right of set-off: If you receive pay from a new employer, your previous employer will be entitled to limit the payment of salary to you unless he/she has waived this right.
  • Counter notice of termination: If you intend to accept a job with a competing business in the notice period and have not been allowed to do so, you must terminate your employment contract yourself by giving counter notice. Please note that, by giving counter notice, you may risk losing your right to for example severance pay because you might not achieve the length of service required to receive such severance pay.

The unemployment insurance fund may advise you on the following topics
Many questions may arise in connection with a termination of employment. Some of these questions can be answered by Finansforbundet's unemployment insurance fund consultant from A&TIL. You may receive advice on the following topics: 

  • When and how to report that you have become unemployed
  • Whether your severance pay will be set off against your unemployment benefits or early retirement benefits
  • Whether you will be quarantined
  • Salary protection insurance from A&TIL
  • A&TIL discounts and events
  • Training opportunities while on unemployment benefits
  • Rules on unemployment and early retirement benefits

If, in your notice period, you plan to start studying or attend a course that continues after expiry of the notice period, it is important that you contact the unemployment insurance fund consultant. Some of the reasons are that limitations apply to the type of courses you may take up while on unemployment benefits. As a result, clarification in this respect is essential before enrolling.
